State of Emergency Ending

On October 17th, 2022, Governor Newsom announced that the COVID-19 State of Emergency (SOE) will end on February 28, 2023. Ultimately, this change simply ends the State of Emergency to allow for COVID-19 response through the SMARTER Plan.

Once the State of Emergency comes to an end, Community Care Licensing waivers will be rescinded and all licensing requirements will be reinstated as of March 1st, 2023. Requests for individual waivers and waivers for multiple facilities are still available to licensees and providers for certain requests following the procedures in PIN 20-06-ASC. PIN 21-24-CCLD

Administrator Certification Program

Effective March 1, 2023, prospective and current Administrators must resume the following:

New Administrators must complete an Initial Certification Training Program via approved in person training.
Recertifying Administrators must complete the 40-hour continuing education requirement by completing at least 20 hours of in-person courses, and no more than 20 online hours.

What this means for you:

You will be able to complete up to 20 hours of online training but the rest must be completed in person.
Initial training courses for ARF and RCFE will resume, in person at our fabulous training space in Reseda, CA.
Continuing Education courses will resume, in person in Reseda, Ventura, Torrance, Pasadena, and even Sacramento, San Diego, and More!

PIN 20-37-ASC

Licensing Requirements Waivers

Until February 28, 2023 this PIN waives the requirements for capacity, bedroom sharing, and staffing ratios to allow for prevention, containment, and mitigation of COVID-19. Also allows more flexibility for staff training and testing, as well as medical assessments for new residents.

What this means for you:

Capacity and bedroom sharing must adhere to the specifications laid out in your plan of operation as licensed.
Staffing ratios must adhere to the specifications laid out in Title 22 RCFE Section §87411 or Title 17 Section §56004 or according to your regional centers guidelines.
Staff training requirements revert to the timelines laid out in Title 22 General Requirements Section §80065 and Title 22 RCFE Section §87411
TB testing requirements revert to the timelines laid out in Title 22 RCFE Section §87865 and Title 22 General Requirements Section §80065
New resident assessments must resume according to the timelines laid out in Title 22 RCFE Section §87569 and Title 22 General Requirements Section §80069

PIN 21-01-ASC

Residential Alternate Care Sites

Until February 28, 2023, this PIN permits the temporary relocation of COVID-19 positive individuals to Residential Alternate Care Sites. Facilities with open beds can accept residents temporarily if needed due to staffing shortages or individual care needs.

What this means for you:

You will no longer be able to temporarily relocate COVID-19 positive residents due to staffing shortages
You will no longer be able to allow residents from another facility to temporarily relocate to your open beds
